Allgemeine Geschäftsbedingungen (AGB)
§ 1 Geltungsbereich, Anbieter
(1) Diese AGB gelten für alle Verträge über digitale Inhalte, die Kunden über den Online-Shop auf omartronics.com mit Omar Draidrya, OmArTronics, Rieckhoffstraße 3, 21073 Hamburg, Deutschland, E-Mail: support@omartronics.com (nachfolgend „Anbieter“) schließen.
(2) Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB). Unternehmer ist jede natürliche oder juristische Person oder rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt (§ 14 BGB).
(3) Abweichende Bedingungen des Kunden gelten nur, wenn der Anbieter ihnen ausdrücklich zustimmt.
§ 2 Vertragsgegenstand
Der Anbieter verkauft digitale Inhalte zum Download, insbesondere 3D-Druckdateien (z. B. STL, 3MF, STEP), CAD-Daten, PDF-Anleitungen, Präsentationen und Software-Projektdateien. Es wird nichts physisch versandt. Inhalt, Dateiformate, Umfang und Systemvoraussetzungen stehen in der jeweiligen Produktbeschreibung.
§ 3 Vertragsschluss
(1) Die Darstellung der Produkte im Shop ist kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Bestellung.
(2) Der Kunde legt Produkte in den Warenkorb, gibt auf der Kassenseite seine Daten ein und wählt eine Zahlungsart. Vor dem Absenden der Bestellung sieht er eine Übersicht mit den Produkten und dem Gesamtpreis. Eingabefehler kann er bis dahin in den Eingabefeldern, im Warenkorb oder über die Zurück-Funktion des Browsers korrigieren.
(3) Mit Klick auf den Bestellbutton „Buy now“ (Jetzt kaufen) gibt der Kunde ein verbindliches Angebot ab. Bei Zahlung mit PayPal wird er danach zu PayPal weitergeleitet und bestätigt dort die Zahlung.
(4) Der Anbieter nimmt das Angebot an, indem er nach Zahlungseingang den Download bereitstellt oder eine Bestellbestätigung per E-Mail versendet, je nachdem, was zuerst geschieht.
(5) Der Anbieter speichert den Vertragstext. Der Kunde erhält die Vertragsdaten und diese AGB mit der Bestellbestätigung per E-Mail. Die AGB sind außerdem jederzeit unter omartronics.com/agb/ abrufbar.
(6) Vertragssprachen sind Deutsch und Englisch.
§ 4 Preise und Zahlung
(1) Alle Preise sind Endpreise. Der Anbieter ist Kleinunternehmer im Sinne von § 19 UStG. Für seine Leistungen gilt die Steuerbefreiung für Kleinunternehmer; Umsatzsteuer wird daher nicht berechnet und nicht ausgewiesen. Versandkosten fallen nicht an.
(2) Der Kunde zahlt über die im Checkout angebotenen Zahlungsarten, derzeit PayPal einschließlich der dort angebotenen Optionen wie „Später bezahlen“. Der Kaufpreis ist mit Vertragsschluss fällig. Für die Zahlung gelten zusätzlich die Bedingungen des jeweiligen Zahlungsdienstleisters.
§ 5 Bereitstellung der digitalen Inhalte
(1) Nach Zahlungseingang stellt der Anbieter die Dateien zum Download bereit: auf der Bestellbestätigungsseite, per Download-Link in der Bestätigungs-E-Mail und, falls der Kunde ein Kundenkonto angelegt hat, im Kundenkonto.
(2) Jeder Download-Link kann bis zu zehnmal genutzt werden. Der Anbieter hält die Downloads mindestens zwölf Monate ab dem Kauf bereit. Auf Anfrage an support@omartronics.com stellt er neue Links bereit.
(3) Der Kunde sollte die Dateien nach dem Download selbst sichern.
(4) Für die Nutzung braucht der Kunde geeignete Hard- und Software, zum Beispiel einen Slicer und einen 3D-Drucker, einen PDF-Betrachter oder eine Entwicklungsumgebung. Die Voraussetzungen stehen in der Produktbeschreibung.
§ 6 Nutzungsrechte (Lizenz)
(1) Mit vollständiger Zahlung erhält der Kunde ein einfaches, nicht übertragbares, zeitlich unbegrenztes Recht, die Dateien für private, nicht-kommerzielle Zwecke zu nutzen. Dazu gehört, die Dateien zu speichern, zu drucken, das Projekt nachzubauen und die Dateien für den eigenen Gebrauch zu verändern.
(2) Ohne gesonderte schriftliche Erlaubnis ist insbesondere nicht gestattet,
- die Dateien oder veränderte Fassungen weiterzugeben, zu verkaufen, zu verleihen oder öffentlich zugänglich zu machen, etwa durch Upload auf Websites, 3D-Plattformen, in Foren oder Tauschbörsen,
- Ausdrucke, Bausätze oder daraus hergestellte Geräte zu verkaufen,
- die Dateien und Anleitungen für Kurse, Unterricht mit Gruppen oder in Unternehmen und anderen Einrichtungen zu nutzen,
- die Dateien oder Anleitungen zum Training von KI-Modellen zu verwenden.
(3) Eine Lizenz für Schulen, Hochschulen, Makerspaces oder gewerbliche Nutzung erteilt der Anbieter auf Anfrage an support@omartronics.com.
(4) Einzelne Bestandteile eines Pakets, insbesondere Firmware und Quellcode, können unter einer Open-Source-Lizenz stehen (zum Beispiel MIT). Für diese Bestandteile gelten vorrangig die Bedingungen der Lizenzdatei (LICENSE) im Paket. Dasselbe gilt für Material Dritter, auf das im Paket hingewiesen wird.
(5) Eine Übersicht der Nutzungsrechte steht unter omartronics.com/license/.
(6) Verstößt der Kunde gegen diese Nutzungsbedingungen, kann der Anbieter die weitere Nutzung untersagen und seine Rechte nach dem Urheberrechtsgesetz geltend machen.
§ 7 Widerrufsrecht
Verbrauchern steht ein gesetzliches Widerrufsrecht zu. Die Einzelheiten stehen in der Widerrufsbelehrung. Bei digitalen Inhalten erlischt das Widerrufsrecht nach § 356 Abs. 6 BGB, wenn der Anbieter mit der Vertragserfüllung begonnen hat, nachdem der Verbraucher ausdrücklich zugestimmt hat, dass der Anbieter vor Ablauf der Widerrufsfrist mit der Vertragserfüllung beginnt, seine Kenntnis davon bestätigt hat, dass er durch seine Zustimmung mit Beginn der Vertragserfüllung sein Widerrufsrecht verliert, und der Anbieter ihm eine Bestätigung nach § 312f BGB zur Verfügung gestellt hat.
§ 8 Mängelrechte und Aktualisierungen
(1) Für die digitalen Inhalte besteht ein gesetzliches Mängelhaftungsrecht (Gewährleistung). Es gelten die gesetzlichen Vorschriften für Verträge über digitale Produkte (§§ 327 ff. BGB).
(2) Mängel und Beschwerden meldet der Kunde bitte an support@omartronics.com. Korrigierte Fassungen stellt der Anbieter über die bestehenden Download-Links oder per E-Mail bereit.
§ 9 Haftung
(1) Der Anbieter haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit, für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, nach dem Produkthaftungsgesetz und soweit er eine Garantie übernommen hat.
(2) Bei leicht fahrlässiger Verletzung einer wesentlichen Vertragspflicht haftet der Anbieter nur für den vertragstypischen, vorhersehbaren Schaden. Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags erst ermöglicht und auf deren Einhaltung der Kunde regelmäßig vertrauen darf. Im Übrigen ist die Haftung für leichte Fahrlässigkeit ausgeschlossen.
(3) Die Projekte arbeiten mit Elektronik, Motoren, Netzteilen und Werkzeugen. Der Kunde beachtet die Sicherheitshinweise in den Anleitungen und die Vorgaben der Hersteller der verwendeten Bauteile.
§ 10 Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Bei Verbrauchern gilt diese Rechtswahl nur, soweit ihnen dadurch nicht der Schutz zwingender Vorschriften des Staates entzogen wird, in dem sie ihren gewöhnlichen Aufenthalt haben.
(2) Ist der Kunde Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, ist Gerichtsstand Hamburg.
(3) Der Anbieter ist nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

§ 1 Scope, seller
(1) These terms apply to all contracts for digital content that customers conclude through the online shop on omartronics.com with Omar Draidrya, OmArTronics, Rieckhoffstraße 3, 21073 Hamburg, Germany, e-mail: support@omartronics.com (the “Seller”).
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession (§ 14 BGB).
(3) Deviating terms of the customer apply only if the Seller expressly agrees to them.
§ 2 Subject of the contract
The Seller sells digital content for download, in particular 3D printing files (e.g. STL, 3MF, STEP), CAD data, PDF guides, presentations and software project files. Nothing is shipped. Content, file formats, scope and system requirements are stated in the product description.
§ 3 Conclusion of the contract
(1) The products shown in the shop are not a legally binding offer but an invitation to order.
(2) The customer adds products to the cart, enters their details on the checkout page and chooses a payment method. Before submitting the order, the customer sees an overview of the products and the total price. Until then, input errors can be corrected in the input fields, in the cart or with the browser’s back button.
(3) By clicking the order button “Buy now”, the customer makes a binding offer. When paying with PayPal, the customer is then taken to PayPal to confirm the payment.
(4) The Seller accepts the offer by making the download available after receipt of payment or by sending an order confirmation by e-mail, whichever happens first.
(5) The Seller stores the contract text. The customer receives the contract details and these terms with the order confirmation e-mail. The terms are also available at any time at omartronics.com/agb/.
(6) The contract languages are German and English.
§ 4 Prices and payment
(1) All prices are final prices. The Seller is a small business under § 19 of the German VAT Act (UStG). The VAT exemption for small businesses applies, so no VAT is charged or shown. There are no shipping costs.
(2) The customer pays using the payment methods offered at checkout, currently PayPal including options offered there such as “Pay Later”. The purchase price is due when the contract is concluded. The payment provider’s terms also apply to the payment.
§ 5 Provision of the digital content
(1) After receipt of payment, the Seller makes the files available for download: on the order confirmation page, via the download link in the confirmation e-mail and, if the customer has created an account, in the customer account.
(2) Each download link can be used up to ten times. The Seller keeps the downloads available for at least twelve months from the purchase. New links are available on request to support@omartronics.com.
(3) The customer should keep their own backup of the files after downloading.
(4) Using the files requires suitable hardware and software, for example a slicer and a 3D printer, a PDF reader or a development environment. The requirements are stated in the product description.
§ 6 Rights of use (licence)
(1) Upon full payment, the customer receives a simple, non-transferable right, unlimited in time, to use the files for private, non-commercial purposes. This includes storing and printing the files, building the project and modifying the files for their own use.
(2) Without separate written permission, the customer may in particular not
- share, sell, lend or make the files or modified versions publicly available, for example by uploading them to websites, 3D platforms, forums or file-sharing services,
- sell printed parts, kits or devices made from the files,
- use the files and guides for courses, group teaching, or in companies and other institutions,
- use the files or guides to train AI models.
(3) The Seller grants licences for schools, universities, makerspaces or commercial use on request to support@omartronics.com.
(4) Individual parts of a package, in particular firmware and source code, may be published under an open-source licence (for example MIT). For these parts, the terms of the licence file (LICENSE) in the package take precedence. The same applies to third-party material identified in the package.
(5) An overview of the rights of use is available at omartronics.com/license/.
(6) If the customer breaches these terms of use, the Seller may prohibit further use and assert its rights under copyright law.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. The details are set out in the withdrawal policy. For digital content, the right of withdrawal expires under § 356(6) BGB when the Seller has begun performing the contract after the consumer has expressly consented to the Seller beginning performance before the end of the withdrawal period, has acknowledged that this consent means losing the right of withdrawal once performance begins, and the Seller has provided a confirmation under § 312f BGB.
§ 8 Defects and updates
(1) A statutory liability for defects (legal guarantee of conformity) applies to the digital content. The statutory provisions for contracts on digital products apply (§§ 327 et seq. BGB).
(2) Please send defect reports and complaints to support@omartronics.com. The Seller provides corrected versions through the existing download links or by e-mail.
§ 9 Liability
(1) The Seller is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where it has given a guarantee.
(2) In the event of a slightly negligent breach of an essential contractual obligation, the Seller is only liable for the typical, foreseeable damage. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. Otherwise, liability for slight negligence is excluded.
(3) The projects involve electronics, motors, power supplies and tools. The customer follows the safety instructions in the guides and the specifications of the manufacturers of the components used.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hamburg.
(3) The Seller is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
